1. Overview

BuyDemoTracks, LLC (“BuyDemoTracks,” “we,” “us,” or “our”) is committed to resolving disputes fairly and efficiently. This Dispute Resolution Policy describes the internal process for handling disputes between users of the BuyDemoTracks platform (“Platform”), including Songwriters, Artists, and BuyDemoTracks.

This policy covers disputes that arise from Platform-facilitated transactions and interactions. For disputes between you and BuyDemoTracks regarding these Terms of Service, please refer to Section 9 of the Terms of Service (binding arbitration).


2. Types of Disputes

2.1 Ownership Disputes

Disputes regarding the ownership or authorship of a Hook, including:

  • Two or more parties claiming authorship of the same Hook
  • Co-writer disputes (one co-writer uploads without the other’s consent)
  • Claims that a Hook infringes an existing copyrighted work
  • Disputes regarding songwriter splits or co-ownership percentages
  • 2.2 Performance Quality Disputes

    Disputes regarding the quality or compliance of an Artist’s Performance, including:

  • Songwriter believes the Performance does not meet quality standards
  • Songwriter believes the Performance materially alters the Hook beyond acceptable creative interpretation
  • Performance was not posted to the required Social Platforms
  • Performance was posted but subsequently removed before the 90-day minimum
  • 2.3 Payment Disputes

    Disputes regarding payments, fees, or financial transactions, including:

  • Songwriter disputes the charge for a Placement
  • Artist disputes the amount or timing of performance payment
  • Disputes regarding refund eligibility or Success Guarantee claims
  • Revenue sharing disputes for commercial use opportunities
  • Platform fee disputes
  • 2.4 Credit and Attribution Disputes

    Disputes regarding proper crediting, including:

  • Artist failed to credit Songwriter in Performance post
  • Incorrect credit information
  • Failure to include required hashtags or Platform attribution
  • 2.5 License Scope Disputes

    Disputes regarding the scope of licensed use, including:

  • Artist used Hook outside the scope of the Platform license (unauthorized commercial use, live performances, etc.)
  • Songwriter claims Content ID revenue that should flow to the Artist’s Master Recording
  • Dispute over whether a use constitutes “commercial” under the agreements

  • 3. How to File a Dispute

    3.1 Filing Process

    To initiate a dispute, submit a Dispute Report by:

    Subject line format: “[Dispute Type] — [Your Username] — [Brief Description]”

    3.2 Required Information

    Your Dispute Report must include:

    a) Your name and Platform username
    b) The other party’s username (if applicable)
    c) Type of dispute (ownership, quality, payment, credit, or license scope)
    d) Placement ID or transaction reference (if applicable)
    e) Detailed description of the dispute, including:
    – What happened
    – When it happened
    – What you believe should happen (your requested resolution)
    f) Supporting evidence, which may include:
    – Screenshots of social media posts
    – Audio files demonstrating ownership
    – Timestamps of creation (voice memos, DAW project files, etc.)
    – Copyright registration certificates
    – Communication records
    – Payment receipts or transaction records

    3.3 Filing Deadline

    Disputes must be filed within sixty (60) days of the event giving rise to the dispute. Disputes filed after sixty (60) days may be declined at BuyDemoTracks’ discretion, except for ownership disputes, which have no filing deadline.


    4. Dispute Resolution Process

    Stage 1: Initial Review (1-3 Business Days)

    Upon receiving a Dispute Report:

    a) BuyDemoTracks assigns a Dispute Coordinator to the case
    b) The Dispute Coordinator reviews the report for completeness and validity
    c) If additional information is needed, the Coordinator contacts the filing party
    d) The other party is notified of the dispute and given five (5) business days to submit a response with their own evidence and perspective
    e) During review, the disputed content or payment may be placed on hold as appropriate

    Stage 2: Investigation (5-10 Business Days)

    The Dispute Coordinator investigates the dispute:

    For Ownership Disputes:

  • Reviews creation timestamps, copyright registrations, and PRO registrations
  • Examines audio evidence for originality and potential infringement
  • May request additional documentation from both parties
  • May consult with music industry professionals for complex cases
  • If a copyright registration exists for one party, this creates a strong (but not conclusive) presumption of ownership
  • For Performance Quality Disputes:

  • Reviews the original Hook and the Artist’s Performance
  • Assesses whether the Performance meets the quality standards defined in the Artist Performance Agreement
  • Reviews whether the Performance was posted on the required platforms and within the required timeline
  • May request both parties to participate in a brief call or exchange
  • For Payment Disputes:

  • Reviews transaction records and payment history
  • Verifies Placement completion and posting requirements
  • Checks refund eligibility against the Terms of Service
  • Reviews Success Guarantee eligibility if applicable
  • For Credit/Attribution Disputes:

  • Reviews the Artist’s social media posts for proper attribution
  • Verifies compliance with credit requirements
  • Assesses whether the Artist has a pattern of attribution failures
  • For License Scope Disputes:

  • Reviews the applicable licensing agreements
  • Examines the specific use in question
  • Determines whether the use falls within or outside the licensed scope
  • Stage 3: Resolution Proposal (Within 15 Business Days of Filing)

    The Dispute Coordinator issues a Resolution Proposal, which may include:

    a) Finding in favor of one party with specific remedies (refund, content removal, payment release, credit correction, etc.)
    b) Compromise solution that addresses both parties’ concerns
    c) Escalation recommendation if the dispute cannot be resolved at this stage

    Both parties have five (5) business days to accept or reject the Resolution Proposal.

    Stage 4: Mediation (If Resolution Proposal Is Rejected)

    If either party rejects the Resolution Proposal:

    a) BuyDemoTracks offers mediation facilitated by the Dispute Coordinator or a senior team member
    b) Mediation is conducted via video call or written exchange, at the parties’ preference
    c) The mediator helps the parties reach a mutually acceptable resolution
    d) Mediation is non-binding — either party may reject the mediated outcome
    e) BuyDemoTracks covers the cost of mediation for the first session (up to 2 hours)

    Stage 5: Final Decision or External Resolution

    If mediation fails:

    a) BuyDemoTracks issues a Final Decision based on the evidence and applicable agreements. This decision is binding with respect to Platform actions (content removal, payment release, account status) but does not prevent either party from seeking external legal remedies.

    b) For disputes exceeding $5,000 in value or involving complex legal questions, BuyDemoTracks may recommend the parties pursue binding arbitration as described in the Terms of Service.

    c) For copyright infringement claims, either party may file a DMCA takedown notice per our DMCA Policy, regardless of the status of the internal dispute process.


    5. Specific Resolution Guidelines

    5.1 Ownership Disputes

    When two Songwriters claim the same Hook:

  • Priority is given to the party with a registered copyright
  • If neither has registered, priority is given to the earliest documented creation date
  • If creation dates are unclear, the Hook may be suspended from the Platform pending resolution
  • Co-authorship claims require evidence of collaborative creation (emails, messages, session notes, etc.)
  • When a Hook is alleged to infringe an existing work:

  • The Hook is temporarily suspended from new Placements
  • The uploading Songwriter is given the opportunity to demonstrate originality
  • If infringement is probable, the Hook is removed and the Songwriter may face account action
  • Existing Placements (already posted by Artists) are handled on a case-by-case basis
  • 5.2 Performance Quality Disputes

    Refund eligibility:

  • If the Performance is objectively deficient (wrong song, unintelligible, significant technical issues), Songwriter receives a full refund and may be re-matched with a new Artist at no cost
  • If the dispute is subjective (Songwriter simply doesn’t like the interpretation), no refund is issued, but BuyDemoTracks may offer a discounted re-match
  • The Artist Performance Agreement gives Artists creative latitude in interpretation — disagreements about style are not grounds for refund
  • 5.3 Payment Disputes

    Artist payment disputes:

  • If the Artist completed and posted the Performance per the agreement, payment is released
  • If there’s a legitimate quality or compliance issue, payment may be held pending resolution
  • Payments held for more than thirty (30) days without resolution are released to the Artist unless a formal dispute is active
  • Songwriter refund disputes:

  • Governed by the refund policy in the Terms of Service
  • Success Guarantee claims are evaluated based on aggregate view data from all Artist Placements

  • 6. Emergency Actions

    BuyDemoTracks may take immediate action without completing the full dispute process in cases of:

    a) Clear copyright infringement (valid DMCA notice received)
    b) Fraud or identity theft
    c) Harassment or threats between users
    d) Unauthorized commercial use of a Hook (clear violation of license scope)
    e) Legal process (court order, subpoena)

    Emergency actions may include content removal, account suspension, or payment holds. The affected user will be notified and may contest the action through the standard dispute process.


    7. Confidentiality

    All dispute proceedings are confidential. BuyDemoTracks will not disclose the details of any dispute to third parties except:

  • To the other party involved in the dispute
  • As required by law or legal process
  • To professional advisors under obligation of confidentiality
  • In anonymized, aggregated form for Platform improvement purposes

  • 8. No Retaliation

    BuyDemoTracks prohibits retaliation against any user who files a dispute in good faith. Retaliatory conduct — including harassment, negative reviews, or deliberate interference with the other party’s Platform activity — may result in account suspension or termination.


    9. Limitations

    9.1 Platform Scope

    This dispute resolution process applies only to disputes arising from Platform-facilitated transactions and interactions. We cannot resolve disputes about:

  • Activities that occurred entirely outside the Platform
  • Agreements between users that were not facilitated by BuyDemoTracks
  • Disputes with third parties not related to Platform use

9.2 Not Legal Advice

BuyDemoTracks’ dispute resolution process is an internal administrative process. Our determinations are not legal rulings. Either party retains the right to pursue legal remedies through the courts or arbitration as provided in the Terms of Service.

9.3 Limitation on Remedies

Remedies available through this process are limited to Platform actions: refunds, credits, content removal, re-matching, account status changes, and payment release or withholding. BuyDemoTracks cannot award monetary damages beyond refund of fees paid.
